GENERAL TERMS OF USE FOR THE WEBSITE

The purpose of this website, bluesystems.io (“Website”) is to provide you with information about the services and activities of Blue Systems USA, Inc., a New York corporation and BlueSystems SAS, a French simplified stock company (collectively “Blue Systems”), which are the subsidiaries within the Bolloré Group, a France-based corporation.

A. Acceptance of the General Terms of Use

The Website User (the “User”) acknowledges that he or she has read all the provisions of these general Terms of Use (the “GTU”) and declares to accept them irrevocably and fully.
Blue Systems may update these GTU at any time. Therefore, the User is encouraged to regularly refer to the current and up-to-date GTU.
Notwithstanding the use of the expressions “we” and “our”, it should be noted that each Blue Systems entity has its own legal identity and that such usage shall not imply any unity between them.

B. Obligations of the User

The User acknowledges that he or she has the skills and resources necessary to access and use the Website. The User must, in particular, refrain from collecting and using the personal information they may access through the Website in any fraudulent manner, and, in general, refrain from any act that would potentially or actually infringe or harm the privacy, sensitivity or brand image of any natural or legal person, and in particular Blue Systems, its subsidiaries, affiliated entities and management, avoiding any defamatory, provocative, malicious or derogatory reference, message or text, by whatever medium. Such content shall be immediately deleted by Blue Systems.

The User undertakes to not use the Website and the information or data contained therein for commercial (other than in connection with Blue Systems’ services), political or publicity purposes, or for any form of commercial solicitation, in particular the sending of unsolicited emails.

Furthermore, the User undertakes to not interfere with the functioning of the computer systems and not to usurp or hijack the identifiers, names or attributes of other Users, and, in general, not to carry out any action that may create confusion among the Users.

D. Intellectual property rights

Subject to the rights expressly granted by Blue Systems, intellectual property rights relating to the documents, writings and information contained on the Website and each of the elements created for the Website are the exclusive property of Blue Systems, who does not grant Users any license or rights, other than that of visiting the Website. In particular, trademarks and other intellectual property rights listed on or associated with the Website are the property of the relevant Blue Systems entities within the Bolloré Group. The reproduction of any documents or information published on the Website is only authorized exclusively for the purposes of information, for personal and private use. Any reproduction and any use of copies made for other purposes is expressly prohibited.

E. Website management

For the purposes of good management, Blue Systems may at any time:

(1) suspend, interrupt or limit access to all or part of the Website;

(2) delete any information that may disrupt the functioning of the Website or be in contravention of applicable laws and regulations; and / or suspend the Website all together.

F. Information about Blue Systems

Blue Systems endeavors to ensure that the information provided on the Website is accurate and up-to-date and reserves the right to correct the content, at any moment and without notice. However, we cannot guarantee that the information made available on the Website is accurate, precise or exhaustive, including all hyperlinks directly or indirectly accessible through the Website.
Therefore, Blue Systems and its affiliates and parent companies accept no responsibility:

G. No liability

Blue Systems shall not be held liable for a lack of availability of all or part of the features of the Website or for the presence of a virus or malware on the Website.

Blue Systems shall not be held liable in the event of an error, fault, crash, operation problems or downtime that disrupts access to the Website or one of its features.

The User assumes full responsibility for the equipment they use to connect to the Website. The User must take all appropriate measures to protect their equipment and their own data, in particular against virus attacks online.
Blue Systems shall not be held liable in the event of legal proceedings against the User as a result of using the Website or any service accessed through the Internet, or as a result of the User not complying with these GTU.
Blue Systems shall not be held liable for any damages suffered by the User, third parties and/or the User’s equipment as a result of connecting to or using the Website.
The Users shall thereby refrain from taking any action against Blue Systems.

H. Hypertext links

The User is prohibited from introducing hypertext links to all or part of the Website, without prior written consent of Blue Systems. Blue Systems reserves the right to refuse this authorization without being required to justify its decision in any way. In the event that Blue Systems grants such authorization, this is in all cases only temporary and may be withdrawn at any time, without the obligation to provide justification.
Any information accessible through a link to other websites is not under the control of Blue Systems, and we accept no responsibility with regard to the content thereof. In any case, any link must be immediately removed at the request of Blue Systems.

I. Applicable law

These GTU are governed by the laws of the State of California and subject to the exclusive jurisdiction of courts located in Los Angeles County, California.
